Cooroora Screens and Blinds, Terms & Conditions of Sale
1. Introduction: The terms and conditions herein are designed to provide certainty to both parties and avoid any misunderstanding. Please read this document carefully and consult your legal representative if you have any questions.
2. Acceptance of this Agreement: By accepting any quotation offered by Cooroora Screens and Blinds for the supply or supply and installation of goods, the Customer accepts the Terms and Conditions as set out below.
3. Price & Quotation
3.1 Cooroora Screens and Blinds will provide a quotation to each client for the goods they are seeking, which is not an offer to sell the goods to the customer. No contract for the supply of the goods shall exist between Cooroora Screens and Blinds and the customer until Cooroora Screens and Blinds has confirmed the quotation by way of the check measure.
3.2 Upon receipt of a 40% deposit, Cooroora Screens and Blinds will arrange with the customer that at a time between 7:00am and 4:00pm Monday to Friday or as otherwise agreed to check measure the quotation. Typically, this will take place within 7 working days of finalisation of the order.
3.3 During the check measure the customer can add or delete items which can change the original quoted price. If this occurs this will be confirmed with a revised quote supplied by Cooroora Screens and Blinds. Following the check measure and confirmation of the final quotation price by Cooroora Screens and Blinds to the customer and acceptance of that final price by the customer to Cooroora Screens and Blinds, Cooroora Screens and Blinds may accept the order. Once production has commenced or external orders placed any deposit paid becomes non-refundable.
4. Delivery & Installation
4.1 As a guide delivery and installation will typically take place 15 to 20 working days from finalisation of the order, for locally manufactured Security Screens and Blinds in standard colours and 20 to 30 working days for non-standard colours. For imported products including Plantation Shutters, delivery is typically 40 to 50 working days from completed check measure. However, it must be noted, that external forces such as public holidays, shipping delays, docking and freight issues can all have an effect on the delivery time of any imported product.
4.2 Once the order is ready for delivery or installation, Cooroora Screens and Blinds will arrange with the customer that at a time or times between 7:00am and 4:00pm Monday to Friday or as otherwise agreed, the goods will be delivered or installed. Any time or times offered by Cooroora Screens and Blinds for the delivery or installation are offered in good faith. Cooroora Screens and Blinds will endeavour to affect the delivery or installation at the time or times agreed however any failure to do so shall not confer any right of cancellation or refusal of the delivery or installation or render Cooroora Screens and Blinds liable for any damages directly or indirectly sustained by the customer as a result thereof.
4.3 The customer is required to provide suitable access to any area required for the delivery or installation and remove any obstruction which could interfere with the delivery or installation or any valuables which could be damaged as a result of the delivery or installation. Cooroora Screens and Blinds will remove any existing screens or window treatments prior to installation as part of our service. Where Cooroora Screens and Blinds is asked to remove any blind or screen from the property the said blinds and or screens will be destroyed and will not be available for return.
4.4 Whilst every care will be taken when delivering or installing the goods no responsibility will be accepted by Cooroora Screens and Blinds for any damage to premises, belongings or interruption to services where such damage or interruption is a result of circumstances beyond the control of Cooroora Screens and Blinds.
4.5 Force Majeure: Cooroora Screens and Blinds will have no liability to the Customer in relation to any loss, damage or expense caused by its failure to complete the Job, or deliver the goods if it is due to a cause reasonably beyond the control of Cooroora Screens and Blinds where Cooroora Screens and Blinds, has used its best efforts to complete the job or supply the goods on time despite the cause. Without limiting this clause such an event shall include the inability of Cooroora Screens and Blinds to complete the job in part or at all.
Payment:
5.1 The payment of any outstanding monies owed to Cooroora Screens and Blinds must be paid upon completion of the delivery or installation. In the event that the entire order is not delivered or installed at the time or times agreed then the customer is required to pay for only those goods that were delivered or installed at the time.
5.2 The Customer must pay the invoice for the Balance in full without deduction, set-off, counter claim or any other claims whatsoever or howsoever.
5.3 Failure by the customer to pay the balance following the delivery or installation of the goods will result in any cost associated with the recovery of the debt being added to the amended balance.
5.4 Upon completion of the delivery or installation and receipt of any outstanding monies payable by the customer, Cooroora Screens and Blinds will transfer ownership of the goods to the customer.
Warranty and Maintenance Products sold or supplied are provided with a warranty exclusive to that product. It is essential that the customer follows the maintenance program outlined in the Warranty and Maintenance Information sheet to ensure coverage by the warranty. Cooroora Screens and Blinds strives to provide quality products manufactured to our high standards and specifications. However, no warranty or guarantee is offered on the performance of any product in the event of wilful damage or misuse.
Interpretation: in these terms and conditions, the following meanings shall apply.
(a)“Cooroora Screens and Blinds” means Chostone Pty Ltd trading as Cooroora Screens and Blinds.
(b)“Customer” means the entity purchasing the goods or services from Cooroora Screens and Blinds.
(c) “Balance” Means the original quoted price less any deposit paid. All Balances must be paid within 48 hours of the completion of the job.
(d) “Amended Balance” Means the new calculated Balance where costs for debt recovery are added on to the original quote supplied by Cooroora Screens and Blinds.
